Terms and Conditions

Bellarch Support Pty Ltd

Welcome to Bellarch Support Pty Ltd. By engaging our services, signing a Service Agreement, or using our website, you ("Client" or "You") agree to these Terms and Conditions ("Terms"). Please read them carefully. If you do not agree, please refrain from using our services.

1. Service Agreements and Onboarding

Before supports commence, Bellarch Support Pty Ltd requires a signed Service Agreement outlining the scope of services, funding arrangements, and agreed terms specific to your support needs. Services will not commence until a Service Agreement is executed. The Service Agreement forms part of these Terms and should be read alongside them.

2. Payments and Funding

Bellarch Support Pty Ltd accepts payment via NDIS plan management, agency-managed funding, or private payment as agreed in your Service Agreement. Invoices will be issued in accordance with the NDIS Price Guide and the terms outlined in your Service Agreement. Clients are responsible for ensuring their NDIS funding is sufficient to cover agreed services. Any changes to funding arrangements must be communicated promptly.

 

3. Cancellations and Rescheduling

We ask that you provide at least 48 hours notice to cancel or reschedule a support session. Late cancellations or no-shows may result in a cancellation fee in accordance with NDIS pricing arrangements and as outlined in your Service Agreement. Exceptions will be considered for emergencies or circumstances outside your control.

Bellarch Support Pty Ltd reserves the right to reschedule or cancel sessions due to staff illness, safety concerns, or circumstances beyond our control. In such cases, you will be notified as promptly as possible and offered an alternative time.

 

4. Use of Images and Media

With your explicit written consent, documented through your Service Agreement, Bellarch Support Pty Ltd may capture and use images or videos of clients for agreed purposes including promotional materials, social media, or our website. Consent is entirely voluntary and may be withdrawn at any time by contacting us in writing. No images or media will be used without prior written consent.

 

5. Client Rights and Responsibilities

Bellarch Support Pty Ltd is committed to delivering supports that uphold your rights under the NDIS Quality and Safeguards Framework, including your right to be treated with dignity and respect, make decisions about your own life, and raise concerns without fear of reprisal.

Clients are expected to engage with our team respectfully and to provide accurate information relevant to the safe and effective delivery of supports. If your needs, circumstances, or NDIS plan change, please notify us promptly so we can adjust your supports accordingly.

6. Safety and Liability

The safety and wellbeing of our clients is our priority. Clients are encouraged to disclose any relevant health, safety, or environmental information that may affect service delivery. Bellarch Support Pty Ltd maintains appropriate insurance and follows all relevant Work Health and Safety obligations.

Our liability is limited to the direct value of services agreed under your Service Agreement, except where liability cannot be excluded by law.

7. Complaints and Feedback

Bellarch Support Pty Ltd takes complaints seriously. If you have a concern, please contact us in the first instance at support@bellarchsupport.com.au. If your concern is not resolved to your satisfaction, you have the right to contact the NDIS Quality and Safeguards Commission at 1800 035 544 or via ndiscommission.gov.au.

8. Privacy

For information on how we collect, store, and use your personal information, please refer to our Privacy Policy. By engaging our services, you agree to the practices outlined in our Privacy Policy.

9. Changes to These Terms

Bellarch Support Pty Ltd reserves the right to update these Terms at any time. Any changes will be posted on our website with the Effective Date updated. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of Queensland, Australia. In the event of a dispute, both parties agree to seek resolution in good faith before pursuing formal legal action.
